Crossing solid: punishment, fine, deprivation of rights

07.04.2021

In Russia, not every motorist tries to comply with traffic rules. Moreover, sometimes it still becomes mandatory to cross a solid line. At the same time, many motorists are experiencing relatively large fines and the risk of losing their driver's license.

Driver's license will not be taken away for avoiding obstacles

Article 12.15 of the Code of Administrative Offenses regulates the following cases when liability nevertheless becomes mandatory:

  1. Departure may involve a violation of traffic rules. In this case, the motorist must pay 5,000 rubles as an administrative fine or lose his driver's license for up to six months.
  2. If a detour of a certain object is mandatory, the situation is different. A motorist can get off with a minimum fine of up to one and a half thousand rubles.

Attention! The rules of the road do not imply that the obstacle will be a traffic jam or a car that has stopped in accordance with the current rules of the road. For this reason, the desire to bypass the formed “traffic jam” can lead to a full fine with a potential loss of rights. An exception, when it will not be necessary to pay a fine and lose a driver's license, will be a solid intersection on the right. At the same time, the inspector should not issue a fine if the obstacle could not be bypassed in another way, and the maneuver was meaningful, safe for neighboring vehicles, forced.

Mandatory penalty: turn - turn around

In many situations, motorists face a mandatory fine when they try to make a left turn or U-turn in a prohibited area. Under such circumstances, the intersection of the solid turns out to be an inevitable aspect. Such a violation of the rules of the road provides for the mandatory payment of a fine. At the same time, you need to understand that the inspector cannot deprive a driver's license.

A motorist who does not reach the end of the solid line, starts a turn and drives up to one and a half meters, may lose 5,000 rubles and a driver's license.

When leaving the lane does not imply a violation of traffic rules

Departure to the lane does not always lead to a violation of traffic rules. In this regard, you need to know the features of various situations that can lead to undesirable situations.

Departure to the marking line becomes possible only if there are no prohibition signs. Otherwise, hitting a solid marking can lead to a fine and even deprivation of a driver's license.

narrow road

Restrictions are removed under the following circumstances on a narrow road:

  • marking is not laid;
  • There are no road signs prohibiting overtaking.

It is important to note that the width of the road always plays an important role, since the absence of markings provides for an even number of lanes. At the same time, the number of lanes depends on the width: 4 or 2. If the road is narrow, there are more maneuvers when traveling.

Any road without markings provides an even number of lanes, so exactly 50% of the roadway is designed for oncoming traffic. At the same time, the road can have 2 or 4 lanes. The number 3 is omitted under such circumstances. In order to avoid a fine, the road must be narrow and must consist of two lanes.

3 lane road

On a 3-lane road with markings, you can leave the middle lane if there are no prohibition signs. In this case, the motorist must have a certain task. For example, he must understand that he needs to turn left. Considering such a situation, a 3-lane road must necessarily have markings, since, otherwise, it may include only two or four lanes, which is determined by the width of the carriageway.

Both situations are exceptions to the rule.

When it is forbidden to drive into the oncoming lane

At the same time, crossing a continuous Code of Administrative Offenses does not always allow. In what cases is it strictly forbidden to leave:

  • 4 lane road

In this case, the exit is prohibited. At the same time, factors such as markings and signs cease to be important. In this case, there can be no exceptions. On such roads, any turns - U-turns should be performed at intersections and in other places where it is allowed by the rules, signs, markings.

  • Prohibition in the form of markings on the road

In this case, the road has special markings, which should prohibit driving into the oncoming lane. Regardless of the number of lanes, exit is prohibited.

  • prohibition signs

In this case, it is also prohibited to enter the lane of oncoming traffic. The penalty for leaving can be very severe.

  • Departure to the left lane of a 3-lane road section

What could be the penalty

In 2017, there are two options for punishment: a fine and deprivation of a driver's license. Important nuances of the circumstances are taken into account, which are interpreted taking into account the current traffic rules:

  • Obstacle avoidance

An obstacle is an immovable object that cannot be moved in the shortest possible time. At the same time, this object does not provide an opportunity for further travel without changing the trajectory of the car. At the same time, a traffic jam or a suddenly stopped car cannot be an obstacle, so they are interpreted differently and the punishment still becomes real. In most cases, the fine is from one thousand rubles to one and a half thousand, and the exact amount is determined by the traffic police inspector.

  • Penalty for attempting to turn or U-turn

In this case, the fine will also be 1,000-1,500 rubles. For this reason, every motorist must abandon such an idea if he does not want to face the traffic police and the mandatory payment of a fine.

  • Other cases

What would be the penalty for crossing the solid line in all other situations? In such situations, punishment follows if the motorist tries to bypass a traffic jam or overtakes neighboring vehicles. Moreover, the driver can drive onto the marking line even with one wheel while making a turn. What will be the punishment in all such situations?

Currently, the situation can be resolved in different ways: a fine or the withdrawal of a driver's license. In addition, the amount of penalties has increased significantly and now amounts to five thousand rubles. If the risk of withdrawal of a driver's license is foreseen, the period is determined on an individual basis and can reach six months. In each situation, the consequences are determined in cooperation with the traffic police inspector.

  • Repeated traffic violation

What are the consequences if the violation occurs again? In this case, there can be serious consequences. For example, a driver's license may be revoked. It is assumed that the driver's license can be withdrawn for up to twelve months. At the same time, if the traffic police inspector has video or photographic evidence, it is almost impossible for a motorist to avoid a fine of up to five thousand rubles. For this reason, it is highly undesirable to repeatedly violate the current legislation.

What are the features of using cameras on the roads

Violations can be recorded by cameras designed for photography and video recording. It is important to note that recently the traffic rules have become softer, so it is far from always necessary to part with a driver's license. In some cases, you can get off with a minimum fine.

It is extremely important to understand that modern cameras cannot determine on what basis a violation was committed. In most cases, a violation is recorded, but at the same time, the nuances that can play a positive role are not fixed on documentary evidence. In this regard, a motorist who has committed the slightest violation sometimes faces the maximum punishment. If such a situation occurs, the decision should be appealed in court. For this, exactly ten days are given after the notification was received. If the outcome is positive, the amount of the penalty can be reduced to 1,000 or 5,000 rubles, which is the minimum level. While there are plenty of opportunities for a positive outcome, it is best to keep a close eye on how the situation develops.

Features of compliance with the legislation of the Russian Federation

Not in all cases, it is easy to comply with the legislation of the Russian Federation and the current rules of the road. For this reason, traffic police inspectors can make the wrong decisions.

What causes errors?

  • poor condition of road surfaces;
  • markup that is of poor quality;
  • excessive length of the induced solid line;
  • regular changes in articles and paragraphs of traffic rules.

It is extremely important to understand that in many situations, traffic police officers, as well as traffic police, try to interpret the current rules not in favor of motorists. Moreover, this becomes possible, since many laws are characterized by inaccurate and ambiguous wording, on the basis of which it is possible to increase the size of the fine if desired.

Despite the existing problems, the overall situation is gradually getting better. For example, about 8-10 years ago, in each case, drivers lost their driver's licenses for violating traffic rules. Now there is an opportunity to get off with a minimum fine. At the same time, if the motorist made overtaking, a fine will still be assigned.

Attention! The minimum penalty can be set when turning through the markings and having to avoid an obstacle. This approach is due to the fact that such maneuvers are practically harmless for other road users, so liability can be reduced. If it is impossible to bypass the fence on the right side, no penalty is imposed at all.

A more serious penalty for crossing a solid line of markings is possible if the motorist creates a potentially dangerous situation. In this situation, the driver must not only pay a fine, but also give away a driver's license for six months. If the violation is repeated, the period may increase up to a year. Most often, such consequences become real when overtaking, even if it was a bicycle or a tractor. In addition, before turning left, you cannot even partially drive into the markings.

Compliance with traffic rules is the best opportunity to protect yourself from unwanted problems.
