Many motorists think that almost any speed limit - be it a sign or a limit established in the traffic rules - means that you can drive at the actual speed plus 20 km/h from the permitted speed. Well, this is almost always the case, but you should consider a small number of subtleties and other risks, which we want to talk about in this article.

How long can you drive under the signs of 40, 60, 70 km/h and others?

The first thing that should be mentioned is that if there is a speed limit sign, then you can drive no more than the speed indicated on it. The point here is not about traffic rules, but about other pitfalls. Yes, very often it is not punishable to drive in excess of no more than 20 km/h, but this is not always the case.

So, the Code of Administrative Offenses gives us the main answer. It is in its 1st part of Article 12.9, which is responsible for fines and deprivation of rights for speeding, that it is established that exceeding 20 km/h is not punishable by any fine at all.

To be more precise, Part 1 has generally lost force since the distant 2013 of the corresponding Federal Law No. 196-FZ. Previously, it was possible to exceed the established speed limit by no more than 10 km/h with impunity. Exceeding 10-20 km/h was then punishable by a fine of only 100 rubles. Few people probably remember that such fines existed at all, because today the minimum is 500 rubles.

But if you drive more than 20 km/h faster than the permitted speed, then you will be fined from 500 rubles, or you may be deprived of your license for up to 1 year.

You should also take into account the error measuring instrument– but this only applies to automatic recording cameras. The cameras in the hands of inspectors on the road practically do not take into account the error, although, of course, it exists.

For automatic recording cameras, this error is usually about 1-2 km/h.

Thus, the selected speed in the area of ​​the speed limit sign is influenced by the following factors:

  • you can drive in excess of 20 km/h without a fine under the Code of Administrative Offences,
  • You can drive at a slight excess of 1-2 km/h due to the errors taken into account by the photo recording cameras.

But it's not that simple!

The fact is that speed errors occur not only in cameras that record violations, but also in the speedometer of your car. Most often, the speed value can be underestimated or overestimated due to a different wheel radius than the one with which the speedometer is calibrated. So, if you installed wheels larger than those with which you bought the car, then real speed will be higher than the speedometer shows, and then the above values ​​​​for your speedometer are not suitable, and you can drive at a lower speed. Be careful!

In addition, and this is already good news, most cars' speedometers initially show about 1-3 km/h higher speed than the real one. Therefore, if you slightly exceeded the limit indicated on the plus sign of 20-21 km/h, then most likely you will not receive a fine for exceeding it.

Features of Avtodoriya

Meanwhile, the same error should be excluded if we are talking about Avtodoriya - types of cameras that work in pairs on one section of the road, are located at a short distance from each other and measure average speed.

In this case, unpunished speeding according to the Code of Administrative Offenses by no more than 20 km/h still works, but the error is practically eliminated.

Why can't you exceed the speed limit except for a fine?

Everything is very simple! To do this, you just need to understand that violation and punishment are not the same thing. If, with a limit of, for example, 60 km/h, you were driving 79, then there will be no fine for this, but traffic violations– specifically clause 10.1 – this does not cancel. And such a violation increases a number of other risks.

The first and most common risk is a traffic accident. Speeding affects the degree of guilt, regardless of the fine, of course. But it’s not so simple - if you drove 50 where you can only drive 40, this, of course, will not automatically make you the culprit. But in situations where not everything is so clear - with mutual guilt, the judge considering the case, when determining guilt, may attribute speeding to an increase in the degree of your guilt.

Also, if you drove at an unpunished speed, but still violated, this will definitely be an aggravating factor when choosing a punishment when a fork is possible, for example:

  • fine or deprivation of rights for some articles of the Code of Administrative Offenses,
  • increasing the term of deprivation where such a period is represented by a range at the discretion of the body considering the case,
  • worsening of the position of the guilty person in a criminal case (for example, if a driver knocked down a pedestrian at a crossing to death or with grave consequences).

What will be the fine if you drive faster?

500 rubles. This is if you still slightly missed the speed limit and exceeded the “forgiven” speed by at least 1 km/h plus 20 km/h plus camera errors.

If you did not notice the speed limit at all and were driving significantly faster than the limited speed, then the following penalties await you. Let's take the 40 kilometers per hour limit as an example:

  • if you were driving 61-80 km/h (exceeded by 20-40 km/h) – a fine of 500 rubles,
  • if you drove 81-100 km/h (exceeded by 40-60 km/h) - fine -1500 rubles,
  • if you were driving 101-120 km/h (exceeded by 60-80 km/h) - a fine of 2000 rubles or imprisonment for 4-6 months (there cannot be imprisonment in a cell, only a fine),
  • if you drove faster than 121 km/h (exceeded by more than 80 km/h) - a fine of rubles or imprisonment for six months,
  • if you were driving 81-100 km/h (exceeded by 40-60 km/h) and have previously been charged for the same violation for about a year - a fine of 2500 rubles,
  • if you were driving faster than 101 km/h (exceeded by more than 60 km/h) and had previously been charged for the same violation for about a year - a fine of 5,000 rubles if the excess was recorded on camera, or imprisonment for a year if you were caught by an inspector Traffic police on the road.

How do I know if I have received a fine?

If you have just driven slightly over the speed limit under a 40, 60, 70 or any other sign, then you cannot immediately find out whether the camera issued a fine or not.

As a rule (depending on the region and type of camera), the fine begins to be displayed on the official website of the traffic police and on State Services in the period from 2-3 days to 2-3 weeks (in the case of Avtodoriya, as a rule, the fine arrives later than ever). Later (here) you will receive a copy of the resolution with a photograph of the excess.

New speed limits on highways in the Moscow region are constantly being introduced. And just recently, 500 new photo and video recording cameras have been installed in such places. The exact dates when these innovations will come into force and specific sections of these routes in the Moscow region have not yet been announced.

Requirements for expressways

In the future, there should also be a section on the M8 highway where speeds of up to 130 km/h will be allowed. This will be the section from 16 to 47 km, but this will not happen before 2018. In the future, it is also planned to speed up the M2 "Crimea" (Simferopol Highway), A104 "Dubna" (Dmitrovskoe Highway) and the M9 "Baltia" (Novorizhskoe Highway) highway. “We will complete the reconstruction of the M9 Baltiya from the Moscow Ring Road to the Big Concrete Ring in 2016, after which we will ask to increase its speed to 130 km per hour. In the same paragraph of the traffic rules in the note, the legislator assigns to the owners or owners of roads the right to allow the movement of certain types of transport at a speed of up to 130 km per hour on certain sections of highways.

The main requirement for the provision of such a speed limit is the owner’s compliance with the conditions to ensure safe traffic on the specified section of the route.

Already, the permitted maximum speed on Russian highways of 130 km/h has allowed owners of category 1A roads to ensure the maximum speed limit in certain sections.

Thus, the Avtodor company, from August 1, 2017, on the M11 Moscow-St. Petersburg highway within the boundaries of 258 km - 334 km, set a speed limit of 130 km per hour. At this point the road bypasses the city of Vyshny Volochok.
